Difference of opinions is likely to surface when Elen Kagan’s nomination to the US Supreme Court hits the Senate floors. Democratic Sen. Kay Hagan has hinted that she will extend her support to the president’s choice of the Solicitor General to serve on the nation’s highest court. “I do plan on supporting her,” said Hagan in a conference call with reporters on Wednesday.

But Senator Richard Burr in a statement on Friday made it clear that he wouldn’t support. “I opposed Ms. Kagan’s nomination to be Solicitor General, and the little additional information provided through the confirmation hearing process has given me no reason to change my mind in support of her to serve on the Supreme Court,” Burr said in the statement, adding, “With no judicial record, I am left with reviewing her decisions in academic life and the policies for which she actively advocated in prior political appointments.” The senator also contended that leaders were concerned over her actions such as barring military recruiters from college campus. He said that his main concern what he termed “her lack of sympathy for law-abiding gun owners.”

Meanwhile, Senator Richard Lugar has become the second in his party to support Elena Kagan as a chief justice. “I have concluded that Solicitor General Elena Kagan is clearly qualified to serve on the Supreme Court and that she has demonstrated a comprehensive knowledge of court history and decisions,’’ Lugar said in a statement. Illinois Senate GOP candidate Rep. Mark Kirk has also put speculations to rest, announced to extend support to Kagan. "With regard to Solicitor General Kagan, I would support her nomination. Ms. Kagan appears to be modest and thoughtful not because she expected this nomination but because she is modest and thoughtful. Under the Constitution, only the President can make this nomination and Solicitor General Kagan is one of the more careful nominees he could have picked," Kirk said in a statement.
